3. Definitions 

Supervisory authority: means an independent public authority established by a Member State, which has the responsibility for monitoring the application of the GDPR in order to protect the fundamental rights and freedoms of natural persons with regard to processing and to facilitate the free movement of data. data in the Union;

Newsletter: if you wish to receive news, updates and information about Holon pharmacies and the products sold therein by receiving our newsletter, we collect your email so that we can send the newsletter with the appropriate frequency. To do so, you must give your Consent for the processing of your personal data (email) for the aforementioned purpose. You can withdraw your Consent whenever you want, as described, and to the contacts indicated in point 11 of this privacy policy.
HolOn data processing: HolOn is an online platform incorporated into the Website that mediates contacts between customers and Holon pharmacies, with the aim of facilitating the process of buying and selling products from Holon pharmacies, through home delivery or collection of products. of the order at the pharmacy near the user's address. Holon collects your personal contact and identification data for the purpose of expediting the order to the pharmacy (e.g., name, billing address, delivery address, CPF, email and telephone contact), giving you the option of creating an account. After confirming the information provided, you will receive an email confirming the order. Your personal data will be processed for the aforementioned purpose for the purpose of carrying out the necessary pre-contractual steps at the request of the data subject and your consent is requested for the communication of the data to the pharmacy in question. In the aforementioned agreement, Holon and the pharmacy jointly determine the means of processing, the way in which your rights are exercised and the way in which information about the processing of your data is provided to you, as well as the security measures applicable to the processing of your data for this purpose. After the contract has been signed with the pharmacy for the delivery of the requested order, your personal data processed within the scope of the contractual execution and for the pharmacy's own purposes are the responsibility of the pharmacy, and you must exercise your rights and obtain information for said processing with the pharmacy. pharmacy.

6. Data recipients

7. Transfers to external countries

We transfer your data to entities located in jurisdictions outside the European Union (EU) or the European Economic Area (EEA) (“external countries”) who are acting as Processors on Holon’s behalf (e.g. IT providers or data centers). As part of our use of the Google Analytics service, we transfer truncated IP addresses to the USA. Additionally, your data may be transferred to social plugin providers; For more information, please consult the privacy policies of these providers.   
In the absence of a decision by the European Commission on the adequate level of protection in the country in question, we conclude contracts in accordance with EU data protection rules which ensure that your rights and freedoms are adequately protected and safeguarded. Alternatively, the data transfer is based on Commission Implementing Decision (EU) 2016/1250 of 12 July 2016 on the level of protection provided by the EU-U.S. Privacy Shield based on Directive 95/ 46/EC of the European Parliament and of the Council. We are happy to provide you with any relevant and detailed information you request.   
Except as set out above, we do not transfer your personal data to countries outside the EU or EEA or to international organisations.  

8. Your rights as the data owner subject

You may at any time invoke your rights listed below against any entity listed in Section 1.  

8.1 Right of access

If the data we process is incorrect or incomplete or if its processing is unlawful, you can request that we rectify, complete or limit the processing of your data or that we delete it to the extent permitted by law (Articles 16, 17.º and 18 of the GDPR). 
There is no right to erasure if the processing of personal data is necessary for (i) the exercise of the right to freedom of expression and information; (ii) for compliance with a legal obligation to which Holon is subject (e.g. minimum data retention periods); or (iii) for the declaration, exercise or defense of legal rights. 

8.3 Right to portability
In the event that you provide us with personal data based on your Consent or in the context of a contractual relationship, Holon will, upon request, deliver said data to you in a commonly used machine-readable format and in a structured form. Where technically feasible, we may also transmit the data to a third party indicated by you.    

8.4 Right of opposition
If we process your data to pursue a legitimate interest, you can object to such processing on grounds relating to your particular situation (Article 21 GDPR). The right to object can only be exercised within the limits of Article 21 GDPR. However, our interests may override the right to cease processing, which means that despite your objection, we may have the right to process your personal data.    

8.5 Right to lodge complaints
Please contact us with your questions, suggestions and criticisms. Under Article 77 of the GDPR, you have the right to lodge a complaint with a supervisory authority, namely the Member State of the European Union where you habitually reside, work or where the alleged infringement of your rights under the GDPR was committed. The right to lodge a complaint is independent of any other administrative or judicial measures.

9. Obligation to provide data  

As a general rule, you are not obliged to provide us with personal data. However, if you do not provide us with your data, we cannot give you access to our Website or process your order or respond to any questions you may send us.

We do not carry out automated individual decisions. If necessary, we may process your data to evaluate certain personal aspects (profiling). If data relating to you is processed for direct marketing purposes, you may object to such processing at any time. If you object to the processing for direct marketing purposes, we will no longer process your data for these purposes.

12.  Personal Data Retention Period

Your data collected through the Website are processed in strict compliance with applicable legislation and are stored in specific databases created for this purpose.
